Each time a user accesses the Heroes Corner website, it is the user’s responsibility to review the current Terms of Service that apply to his/her transactions and use of this site. If the user is dissatisfied with the Heroes Corner website, the content or Terms of Service, then the user agrees that the sole and exclusive remedy is to discontinue using the Heroes Corner website.
Tampering with this site, misrepresenting the identity of a user, using buying agents or conducting fraudulent activities on the site are prohibited. Disclaimers and Limitations of Liability By using the Heroes Corner website, you expressly agree that use of the Heroes Corner website is at your sole risk. The Heroes Corner website is provided on an “AS IS” and “AS AVAILABLE” basis. Neither Heroes Corner nor each of their partners, employees, agents, third-party content providers, designers, contractors, distributors, merchants, sponsors, licensors, or the like (collectively “ASSOCIATES”) warrant that use of the Heroes Corner website will be uninterrupted or error-free. Neither Heroes Corner nor its Associates warrant the accuracy, integrity or completeness of the content provided on the Heroes Corner website or the products or services offered for sale on the Heroes Corner website. Further, Heroes Corner makes no representation that content provided on the Heroes Corner website is applicable to, or appropriate for use in, locations outside of the United States of America. Heroes Corner and its Associates specifically disclaim all warranties, whether expressed or implied, including but not limited to warranties of title, merchantability or fitness for a particular purpose. No oral advice or written information given by Heroes Corner or its Associates shall create a warranty. Some states do not allow the exclusion or limitation of certain warranties, so the above limitation or exclusion may not apply to you. Under no circumstances shall Heroes Corner or its Associates be liable for any direct, indirect, incidental, special or consequential damages that result from your use of or inability to use the Heroes Corner website, including but not limited to reliance by you on any information obtained from the Heroes Corner website that results in mistakes, omissions, interruptions, deletion or corruption of files, viruses, delays in operation or transmission, or any failure of performance. The foregoing Limitation of Liability shall apply in any action, whether in contract, tort or any other claim, even if an authorized representative of Heroes Corner has been advised of or should have knowledge of the possibility of such damages. User hereby acknowledges that this paragraph shall apply to all content, merchandise and services available through the Heroes Corner website. Some states do not allow the exclusion or limitation of certain warranties, so the above limitation or exclusion may not apply to you. Online Conduct User agrees to use the Heroes Corner website only for lawful purposes. User is prohibited from posting on or transmitting through the Heroes Corner website any unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, sexually explicit, profane, hateful, racially, ethnically, or otherwise objectionable material of any kind, including but not limited to any material that encourages conduct that would constitute a criminal offense, give rise to civil liability, or otherwise violate any applicable local, state, national or international law. If Heroes Corner is notified of any book, information, data, software, photographs, graphs, videos, typefaces, graphics, music, sound, and other material on the Heroes Corner website (collectively “CONTENT”) provided by user that is allegedly infringing, defamatory, damaging, illegal, or offensive, Heroes Corner may investigate the allegation and determine in its sole discretion whether to remove or request the removal of such content from the Heroes Corner website. Heroes Corner may disclose any content of electronically communications of any kind (i) to satisfy any law, regulation, or government request; (ii) if such disclosure is necessary or appropriate to operate the Heroes Corner website; or (iii) to protect the rights or property of Heroes Corner and its Associates and any other user. Notwithstanding the foregoing, Heroes Corner cannot ensure prompt removal or questionable content after online posting. Accordingly, Heroes Corner shall not assume liability for any action or inaction with respect to conduct, communication, or content of any third party on the Heroes Corner website. Password and Account Security Every user that has an account on the Heroes Corner website is responsible for (i) keeping his/her account password confidential and secured; (ii) restricting access to such user’s computer; and (iii) keeping the email address associated with that account current (user acknowledges that is it important to keep the email address associated with his/her account current because although the user may be able to log into his/her Heroes Corner website account using an old email address, such user will not receive messages from Heroes Corner about his/her order and inquiries or other matters). User accepts full responsibility for all activities that occur with such user’s Heroes Corner website account. Age of Users Heroes Corner does not intend that Heroes Corner website to be used by individuals under the age of 18 (a “MINOR”) without the supervision of a parent or guardian 18 years of age or older (a “GUARDIAN”). Heroes Corner relies upon Guardians to determine if any content or items available on the Heroes Corner website is appropriate for the viewing, access or purchase by such minors. If a user is a minor, such minor may only use the Heroes Corner website under the supervisor of a Guardian. Product Display / Colors The Heroes Corner website attempts to display product images shown on the site as accurately as possible. However, we cannot guarantee that the color you see matches the product color, as the display of the color depends, in part, upon the monitor you are using. Errors on Our Site Prices and availability of products and services are subject to change without notice. Errors will be corrected where discovered, and Heroes Corner reserves the right to revoke any stated offer and to correct any errors, inaccuracies or omissions including after an order has been submitted and whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is cancelled, Heroes Corner will issue a credit to your credit card account in the amount of the charge. Individual bank policies will dictate when this amount is credited to your account. If you are not fully satisfied with your purchase, you may return it in accordance with the Heroes Corner Return Policy. Newsletter Each user / customer that registers with Heroes Corner will automatically be registered to receive the Heroes Corner Newsletter (herein “NEWSLETTER”). The Newsletter will contain information determined beneficial by Heroes Corner. The Newsletter will be emailed to the user / customer using the email address provided. Users / customers have the right to cancel receiving the Newsletter emailed to them. The user / customer may cancellation their subscription either using the Account Maintenance or sending an email to Heroes Corner requesting cancellation. Sales Tax In accordance with current US tax law, Heroes Corner is only required to collect sales tax on any transaction where the buyer resides in the same state as Heroes Corner. Users living in Indiana will be charged the appropriate tax for each order. Users that live outside of Indiana will not be charged sales tax. Paying for Your Order Heroes Corner currently accepts Visa®, Mastercard® and money orders. All payments must be made in United States currency. Customer / members paying by credit card accept responsibility to have sufficient funds available on their credit card prior to placing an order with Heroes Corner. In addition, customer /members will accept legal responsibility for payment to Heroes Corner of all outstanding debt from placing orders on the Heroes Corner website. If paying with a money order, then, prior to placing the order, the customer is responsible for contacting and requesting permission from Heroes Corner to accept a money order. If the money order is accepted as a means of payment, then a credit card must still be on file in the event the user is owed a refund / credit due to an item being cancelled. The credit card will be the means to refund merchandise value in the event the user does not want store credit. For each order month, Heroes Corner will post the estimated schedule for charges to credit cards on the HeroesCorner.com website. It is the customers / members responsibility to make themselves aware of the charge date. However, Heroes Corner reserves the right to deviate from the charge schedule based on special circumstances such as, but not limited to, catastrophic events, situations beyond their control, and customers who have a history of delinquent payment. If a customer / member contacts Heroes Corner with a request to postpone a scheduled charge, then Heroes Corner may assess a $10 fee to cover the costs of merchant account batch fees and scheduling a Heroes Corner staff member to process the charge outside the original schedule. Heroes Corner may pre-authorize a customer / member's credit card at the time the order is placed, which may affect the customer / member's credit line. Customer / members should contact their credit card issuer for more information. Declined Credit Card / Delinquent Payment
A customer / member will be deemed as delinquent if he/she has non-sufficient funds in their account resulting in their credit card being declined upon Heroes Corner charging their credit card for an order. Customer / members that have a second delinquent incident in a six (6) month period may result in a $25 re-processing fee to cover the costs of re-charging a credit card and scheduling a Heroes Corner staff member to charge the card. Customer / members that have a history of delinquent payment and/or settled their debt exceeding 30 days from the date of original charge may have the following sanctions imposed on their account: account closed with Heroes Corner, required to submit a money order payment for future orders, credit card charged at the close of the Order Due Date, and/or credit card funds must be received prior to Heroes Corner processing the order. Default Payment Customer / members that have not settled their debt with Heroes Corner within 30 days from the date of scheduled payment will accept the following, but not limited, repercussions: their account may be turned over to a collection agency, defendant in legal action, and/or forfeiture of all pending items as collateral for unpaid debt. Using Digital Coupons Digital Coupons will be automatically applied to purchase totals, up to the total purchase amount. Digital Coupons must be used prior to their noted expiration date and within a single transaction. Digital Coupons cannot be replaced if it is lost, stolen, deleted, or if you cancel or return your purchase. In the event of a reduction in price below the coupon value, the excess value of the coupon will not be refunded. 50/50 Preferred Cover Option For select titles solicited with 50/50 covers, customers / members may select a cover that they would prefer to receive. Heroes Corner makes no explicit or implicit guarantee’s that a member's preference will be granted. Heroes Corner will attempt to fill the member's cover preference, which will based upon the following factors: 1. The order in which the request was received; 2. The total number of requests for the same cover requested by other members;
3. The popularity of the solicited title; and 4. The number of cover copies provided to Heroes Corner by the comic distributor.
A customer / member that does not receive their preferred cover has no recourse such as a refund, and accepts the comic cover provided to them. Validating Your Order After the user places an order through the Heroes Corner website using the site’s provided shopping cart, Heroes Corner will check the user’s provided information for validity, by verifying the user’s method of payment or shipping address. Heroes Corner reserves the right to reject any order the user places through the Heroes Corner website, and/or to limit quantity of any order, without giving any reason. If Heroes Corner rejects a user’s order, Heroes Corner will attempt to notify the user through the user’s provided email address that the user had provided at the time of the order. Normally, Heroes Corner will not charge the user’s Visa® or Mastercard® if the order was rejected, but Heroes Corner will provide a refund in the event a charge was made against the user’s card. Order Acceptance / Confirmation The user’s receipt of an electronic or other form of order confirmation does not signify that Heroes Corner accepts the user’s order, nor does it constitute confirmation of Heroes Corner’s offer to sell. Heroes Corner reserves the right at any time after receipt of a user’s order to accept, decline, or limit the quantities purchased per person, per household or per order for any reason. Heroes Corner also reserves the right to reject any order placed. These restrictions may include orders placed by the same Heroes Corner website account, the same credit card, and orders that use the same billing and/or shipping address. Heroes Corner reserves the right to limit or prohibit sales to dealers. In the event Heroes Corner makes a change to an order, Heroes Corner will attempt to notify the user through the user’s provided email address that the user had provided at the time of the order. Cancellation Policy
Every order received from a customer is special ordered through a distributor. Once Heroes Corner places an order with its distributor, the distributor holds Heroes Corner liable for payment for ordered items and has a restrictive cancellation policy. Heroes Corner passes this restrictive cancellation policy onto its customers / members. Heroes Corner will only honor a members’ cancellation request if they notify us at least 24-hours before the respective monthly Order Due Date.
If a member provides notification after the 24-hour deadline, then Heroes Corner reserves the right to refuse to cancel the order and the customer / member accepts responsibility for payment.
In the rare event Heroes Corner is able to cancel an order after the respective Order Due Date, Heroes Corner may assess the customer / member a 20% cancellation fee to cover the costs of credit card re-processing and updating inventory data.
Return Policy Heroes Corner will not be held responsible for any damaged products that were caused by the shipping company. Heroes Corner will not accept returns because the user / customer was unhappy with the item, such as narrative content not to the customer’s liking, or the way a statute/bust/toy was designed. Returns will only be accepted if Heroes Corner made a mistake or the item was damaged due to our negligence. However, Heroes Corner conducts a cursory inspection of all items, especially comics / graphic novels, prior to shipment. Heroes Corner will not ship out any comics / graphic novels that have discoverable large tears and folds. Heroes Corner makes no explicit or implicit guarantees that a customer’s comics will be delivered in mint condition. Heroes Corner strives to provide comics in VF/NM condition, with a majority of comics delivered in near-mint condition or better. Upon receiving an order, any customer that detects a discrepancy in the order or believes the product was damaged due to Heroes Corner negligence, must contact Heroes Corner within forty-eight (48) hours of the order’s delivery. Shipping Costs Heroes Corner’s shipping rates are based upon contracted carrier shipping and handling fees, and packaging costs. Customers will be quoted a shipping rate prior to checking out. Customers that submit an order with a purchase value equal to or exceeding $75 will receive a discounted shipping rate. For current shipping rates, please see our FAQ titled “Current Shipping Rates.” Heroes Corner does not provided service outside the continental United States. Shipping Address Heroes Corner will ship to the address provided by the customer in each respective order. If a customer desires a package shipped to different location from the address originally specified, then the customer must notify Heroes Corner Customer Support via email no later than 72-hours prior to shipment. Heroes Corner will not assume liability or responsibility for sending a package to the improper address if the customer fails to provide email notification or fails to provide email notification within the time-frame specified. PO Box Shipping Address / Extra Shipping Fee If a customer / member provides a PO Box as a shipping address and the cost of shipping via the United States Postal Service (USPS) exceeds the cost of using another Heroes Corner shipping provider, then the customer / member may be assessed an additional shipping fee because USPS is the only shipper that services PO Boxes. Customer / members that submit an order with a PO Box shipping address that fall under the above situation will receive email notification from Heroes Corner prior to processing. The customer / member will have the option to pay the additional shipping fee or cancel their order without penalty. When shipping to a PO Box using USPS there will be no insurance unless the customer requests insurance at least 72-hours prior to shipment. In addition, the customer / member bear the responsibility to pay for the insurance. If a USPS shipment does not have insurance and a package is lost or damage then Heroes Corner will not assume responsibility for replacements or issuing a refund. Heroes Corner strongly encourages customer / members to ship to a physical address. By shipping to a physical address, Heroes Corner may use FedEx as its shipper, depending on the quantity and type of items shipped, and all shipments are provided with free limited-insurance. Contracted Shippers Heroes Corner has the sole discretion to select any shipper to deliver purchased merchandise to a customer. If a customer requests a specific shipper or shipping method, then the customer agrees to pay any extra shipping fees that Heroes Corner may incur beyond its typically shipping methods. Heroes Corner refers to these special requests herein as SPECIAL SHIPPING. SPECIAL SHIPPING requests may void standard shipping rates posted by Heroes Corner. For Special Shipping requests, it is the user’s/customer’s responsibility to contact Heroes Corner at least 72 hours prior to placing an order and prior to the order deadline. Any order placed without contacting Heroes Corner first or after the order deadline, may result in the user/customer having to accept the Heroes Corner normal mode of shipping. During fulfillment of a customer’s shipping option, Heroes Corner will attempt to provide the customer with their package within 1-6 business days from the date/time of shipping. However, Heroes Corner has no control over delays that a shipper may encounter. Delayed Products / Unfilled Orders At times, publishers may delay release of an advertised item. Heroes Corner has no control over a publisher’s time-table to release an item to the public for sale or provide Heroes Corner with the item. Therefore, a customer may not receive everything ordered (herein OUTSTANDING ITEMS) when Heroes Corner ships a package using the customer’s chosen shipping option (See SHIPPING RATES). If a customer has only placed one order with Heroes Corner, then any outstanding items will be shipped after all items have been received. Under this situation, Heroes Corner will ship the outstanding items free of charge. If a customer has placed another order, then any outstanding items received will be included in the customer’s next scheduled shipment that corresponds with their latest order. If a customer does not want to wait until all items are received or until their next scheduled shipment, then the customer may offer payment of $5.95 to receive any currently received items that were outstanding.
Termination of Use Heroes Corner may, in its sole discretion, terminate a user’s account or the user’s use of the Heroes Corner website at anytime. Users are personally liable for any orders placed or charges prior to termination. Heroes Corner reserves the right to change, suspend, or discontinue all or any aspects of the Heroes Corner website at any time without prior notice.
